The EU AI Act for Indian Software Exporters: The Revised Timeline and What to Build

What changed

On 7 May 2026 the Council and Parliament reached a provisional 'digital omnibus' agreement that would move obligations for stand-alone high-risk systems (Annex III) from 2 August 2026 to 2 December 2027, and for AI embedded in regulated products (Annex I) from 2 August 2027 to 2 August 2028. Parliament voted to adopt it on 16 June 2026; the changes take legal effect only once formally adopted and published.

Other parts of the Act, including obligations for general-purpose AI models, already apply.

Does it apply to you

The Act applies to providers placing AI systems on the EU market and to systems whose output is used in the EU, wherever the developer is based. Indian firms building HR screening, credit scoring, education assessment or medical software for European clients should check whether their use case is listed as high-risk.

What to build now

Classify each AI feature by risk. For anything potentially high-risk, start the technical documentation, data-governance records, logging, human-oversight design and accuracy testing now. These are good engineering practice regardless of regulation.

Track the final text closely: dates and details may still move before publication.
